Growing Past 5 Employees in California: What Actually Changes?
Five employees is a meaningful threshold, but it does not automatically make every HR document mandatory.
Growth changes the laws and processes that may apply. Two important examples are harassment prevention training and the California Family Rights Act (CFRA).
Harassment prevention training
Employers with five or more employees generally must provide training every two years: at least two hours for supervisors and one hour for nonsupervisory employees. Review timing rules for new hires and newly promoted supervisors.
CFRA coverage
CFRA generally covers employers with five or more employees. Employee eligibility has additional requirements, including service time and hours worked, so do not treat headcount as the only test.
What to do now
Map headcount across locations, review training dates, update leave intake steps and make sure supervisors know when to escalate a request.
